Internet Kmoraine
The
Acceptable Use Policy is intended to set forth the terms and conditions of use
of service and help protect Internet Kmoraine customers and the Internet
community from abusive use of the Internet. A customer's use of Internet
Kmoraine service constitutes acceptance of this Acceptable Use Policy. Internet
Kmoraine reserves the right to revise and update this Acceptable Use Policy from
time to time, so you should periodically review the policy to see if it has been
changed.

Unauthorized use of Internet Kmoraine services includes, but is not limited to,
the following examples: illegal or criminal activities; sending or posting
fraudulent or harassing electronic messages (including "spamming"-sending a
message's content to an unreasonable number of mail addresses or message areas,
as well as unsolicited mailing of commercial sales pitches); posting messages to
public message areas which violate any restriction in that area's charter or
policy; use, attempted use or possession in one's account of programs in order
to interfere with Internet Kmoraine's system, defraud customers or gain
unauthorized access to computers, networks, file areas or system privileges;
taking unauthorized actions on IRC servers, such as cloning and running bots
intended to take malicious action; placing pictures of nudity in Internet
Kmoraine WWW directories; or, placing files containing commercial software in
file areas accessible by the public.
A violation of the
Acceptable Use Policy may result in a termination of your privileges. Any refund
of prepaid fees will be subject to offset of administrative charges incurred by
Internet Kmoraine. Refunds for accounts closed due to a direct violation of the
User Policy Agreement will only be granted at the discretion of Internet
Kmoraine.
Account Limitations
Standard Internet Kmoraine accounts are limited to one PPP login per account at
any given time. A standard Internet Kmoraine account provides access to browse
the Internet, and should only be connected when a user is actively using the
Internet. A standard Internet Kmoraine account shall not be used to run a server
providing an information service over a user's modem connection such as an FTP
or WWW server. A connection held for extended periods of time by automated
methods or server software are in violation of this Policy, and will have their
connection terminated, account suspended and/or billing for dedicated modem/line
services at the rate of $125.00 for the month in which the infraction occurred.
No subscriber is permitted to "resell" his/her account or use of their
connection in any way including private "web page", "home page" or
telecommunications (BBS) services. Doing so will result in immediate
disconnection. Internet Kmoraine, although not engaged in censorship of
materials gained through use of the Internet and our subscribers' connections,
strictly prohibits the publication of obscene material, photography or images or
malicious text intended to slander or liable any individual or company on any
"home page", "web page" or postings within the Internet Kmoraine network. Doing
so will result in immediate removal of all materials and disconnection of
services.
Although a Standard Internet Kmoraine account allows unlimited monthly access,
to insure the system is not abused and all customers have equal access, a
connection may be disconnected after eight (8) consecutive hours of
connectivity.
Internet Kmoraine may take any one or more the following actions in response to
violations of this Acceptable Use Policy:
» Issue written or verbal warnings
» Suspend the customer's account
» Terminate the customer's account
» Deny the customer future service
» Bill the customer for administrative costs and/or
reactivation charges, as appropriate
All
new accounts are due and payable prior to the period subscribed or WITHIN 10
DAYS of the invoice date if the account is a "billed account". We accept cash,
check, or major credit cards for payment of accounts. All billed accounts will
be invoiced 10-15 days in advance of the expiration date and will be due and
payable before the period subscribed or renewed for. It is assumed that the
subscriber is renewing their service in order to prevent interruption of their
services unless written notification by email or US Postal is received by
Internet Kmoraine to the contrary. INTERNET KMORAINE MUST BE NOTIFIED 30 DAYS IN
ADVANCE OF THE NEXT TERM OF ANY CANCELLATIONS. REFUNDS WILL ONLY BE ISSUED FOR
CUSTOMERS CANCELING DUE TO MOVING OUT OF THE AREA OR VALID COMPUTER PROBLEMS
THAT PREVENT THEM FROM USING THE SERVICE.
Technical Support Policies
Internet Kmoraine offers free technical support to assist customers with the
setup and configuration of Internet Kmoraine Internet accounts. The customer
must confirm with their local telephone provider that calling any access number
is a local call. Internet Kmoraine is not responsible for any long distance
charges incurred.
Internet Kmoraine offers telephone based technical support during operating
hours. This support line is for customers who are having problems making a
connection to Internet Kmoraine and/or are having problems receiving and sending
e-mail using e-mail services from Internet Kmoraine. This support line can
not be used to answer questions on non-connection problems such as installing
add-on programs for your browser, printer or scanner issues, and the like.
Internet Kmoraine can not provide support for any Internet software that we do
not supply, nor can we guarantee the performance of any Internet software that
we do not supply. Internet Kmoraine can not provide support for any other
Internet connection from another service provider, nor can we provide support
for any web based e-mail services such as HotMail, Yahoo Mail, or any other.
Internet Kmoraine can not guarantee performance/reliability of any other
services outside of the Internet Kmoraine network, this includes other
organization's web servers, other organization's e-mail servers, your telephone
line, quality of that telephone line and/or any other service provided by your
local telephone company.
Customers may also receive E-mail based technical support from
support@Kmoraine.com.
E-mail messages are answered based on priority and most messages will be
responded to by the next business day after receipt.
Basic Access Account
Internet Kmoraine does offer technical support by means other than telephone or
E-mail at an additional charge. An in-store technical call (you bring your
system to us) is charged at $35.00 per hour.
All Accounts
House
calls carry a $35.00 trip charge which covers up to 20 miles, with time charged
at $35.00 per hour/one hour minimum. Any networking/computer setup support is
under the stipulations and charges set forth in the job order for that
particular event. Internet Kmoraine is not responsible for the performance of
services provided by organizations outside of Internet Kmoraine: including the
quality of a customer's phone lines, the speed of Internet connections not owned
or operated by Internet Kmoraine, the operation or reliability of any Internet
server or computer not owned or operated by Internet Kmoraine.
DISCLAIMER
The Internet Kmoraine service provided is provided on an AS IS, AS AVAILABLE,
BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT
NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE
OR NON-INFRINGEMENT.
INTERNET KMORAINE EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT THE
INTERNET KMORAINE SERVICE WILL BE ERROR-FREE, SECURE OR UNINTERRUPTED. NO ORAL
ADVICE OR WRITTEN INFORMATION GIVEN BY INTERNET KMORAINE, ITS EMPLOYEES,
LICENSORS OR AGENTS WILL CREATE A WARRANTY; NOR MAY YOU RELY ON ANY SUCH
INFORMATION OR ADVICE. The terms of this section shall survive the termination
of this agreement for whatever reason.
UNDER
NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, WILL INTERNET KMORAINE, OR ITS
AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR
CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF OR INABILITY TO USE THE
INTERNET KMORAINE SERVICE, including but not limited to reliance on any
information obtained on the Internet Kmoraine service; or that result from
mistakes, omissions, interruptions, deletion of files or e-mail, loss of or
damage to data, errors, defects, viruses, delays in operation, or transmission,
or any failure of performance, whether or not limited to acts of God,
communication failure, theft, destruction or unauthorized access to Internet
Kmoraine records, programs or services. YOU HEREBY ACKNOWLEDGE THAT THIS
PROVISION WILL APPLY WHETHER OR NOT INTERNET KMORAINE IS GIVEN NOTICE OF THE
POSSIBILITY OF SUCH DAMAGES AND THAT THIS PROVISION WILL APPLY TO ALL CONTENT,
MERCHANDISE OR SERVICES AVAILABLE FROM INTERNET KMORAINE OR ITS AFFILIATES. THE
TERMS OF THIS SECTION SHALL SURVIVE ANY TERMINATION OF THIS AGREEMENT.
INTERNET KMORAINE RESERVES THE RIGHT TO MODIFY THIS POLICY AT ANY TIME AND
WITHOUT ADVANCE NOTICE.
The
above policies are effective retroactively from October 1, 1998 and apply to all
accounts currently serviced by Internet Kmoraine for the purpose of providing a
better service to our current subscribers.
